ESTATE PLAN SUMMARY

Nelsen Law Offices can help you with your simple, or complex, estate planning needs. Our attorneys can custom draft your estate plan to provide for your specific situation, however, we have found that most of our clients’ needs are met with 5 basic estate planning tools. We call this our “standard estate plan” and it includes all of the following:

 

  1. Pour-Over Will (one per spouse): A Pour-Over Will is used for two primary purposes. First, to specifically appoint who you would like to raise your minor children should something happen to you and your spouse (if applicable). Second, a Pour-Over Will also collects all of your personal property and pours it into a Living Trust, thereby avoiding probate. 

  2. Revocable Living Trust: A revocable living trust is the best, and most common, way to ensure that your assets avoid probate upon your death. Your trust will specifically delineate to whom your property will be given upon your passing. You have complete control of this process, and remain in control of your property during your entire lifetime. 

  3. Powers of Attorney (one per spouse): Our standard estate plan includes financial powers of attorney for each spouse as well as healthcare powers of attorney. A financial power of attorney will give your chosen agent the authority to act on your behalf in all financial affairs should you ever become incapacitated or otherwise unable to act on your own. A healthcare power of attorney will give your chosen agent the ability to gain access to medical records, sign medical documents, and otherwise act on your behalf for medical related issues. 

  4. Healthcare Directives: A healthcare directive will allow you to make very important healthcare decisions, including end of life decisions, now. This will alleviate the stress of family being forced to make these decisions on your behalf, as well as ensure your choices are honored during the most stressful of times. 

  5. Funeral & Burial Instructions: Our standard estate plan allows you to make decisions regarding burial/cremation preferences, burial plots, as well as funeral directives. This is yet another way to alleviate the stress from your loved ones during a very emotional time.
